Warranty Terms

You are obliged to regularly check your UPVC windows and doors for correct operation and by following our maintenance guide you should not experience any difficulties. If after a two year period you fail to report any maintenance issues we will apply our standard call out charge.

Maintenance

The accumulation of atmospheric grime and pollution make it necessary to clean the surface of your UPVC regularly to maintain its good appearance. In badly polluted industrial, marine or large city locations it is recommended that cleaning is carried out every three months, in relatively cleaner rural areas once every six months.

Provided this recommended frequency is maintained it should never be necessary to use cleaner's which are more aggressive than a non alkaline detergent in warm water in concentration which can be handled with bare hands and applied to frames using a sponge or soft cloth.

Ford Windows Ltd products are designed to reduce maintenance, but your attention is drawn to the necessity of regular lubricant spray onto hinges & fitting at least once a year or more frequently, as local conditions demand. All drainage holes, roller tracking and lock pin location points should be kept clear from debris and obstructions. The company reserves the right to make a reasonable charge to replace any lock or handle that fails to operate properly due to lack of lubrication.

Warranty Terms

1.1 in these terms:

  • "Ford" means Ford Windows Limited.
  • "Goods" means the sealed units, the fittings and framework, or any of them, which Ford is to supply.

1.2 Reference to a provision of a statute shall be construed as a reference to that provision as amended, re-enacted or extended at the relevant time.

2.1 Subject to the following provisions, Ford warrants that:

  • The framework will be free from discolouration, warping and cracking due to defective materials, manufacture or workmanship for a period of 10 years from the date of the initial use of the Goods or from the date of delivery, whichever is the first to expire.
  • That the fittings (meaning the handles, lock or hinges) will be free from defects due to defective materials, manufacture or workmanship for a period of 2 years from the date of their initial use or the date of delivery, whichever is the first to expire.
  • That the sealed units will be free of defects due to defective materials, manufacture or workmanship for a period of 10 years from the date of their initial use or the date of delivery, whichever is the first to expire.

2 The warranty is given by Ford subject to the following conditions:

  • Ford shall be under no liability in respect of any defect in the Goods arising from a drawing, design or specification supplied by you.
  • Ford shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow Ford's instructions (whether oral or in writing), misuse or alteration or repair of the Goods without Ford's approval.
  • Ford shall be under no liability under the warranty if the total price for the Goods has not been paid by the due date of payment.
  • The warranty does not extend to parts, materials or equipment not manufactured by Ford in respect of which you will only be entitled to the benefit of any such warranty or guarantee as is given by the manufacturer to Ford.

3. Subject as expressly provided in this warranty, and except where the Goods are sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

4. Where the Goods are sold under a consumer transaction (as defined by the Consumer Transactions (Restrictions on Statements) Order 1976) your statutory rights are not affected by these terms.

5. Any claim must be notified to Ford within 7 days from the date of delivery of the Goods or (where the defect or failure was not apparent on reasonable inspection) within a reasonable time after discovery of the defect or failure.

6. Where a valid claim in respect of any of the Goods which is based on a defect in the quality or condition of the Goods is notified to Ford in accordance with these terms, Ford may replace or repair the Goods (or the part in question) free of charge or, at Ford's sole discretion, refund to you the price of the Goods (or a proportionate part of the price) in which case Ford shall have no further liability to you.

7. Except in respect of death or personal injury caused by Ford's negligence, or liability for defective products under the Consumer Protection Act 1987, Ford shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or for loss of profit or for any indirect, special or consequential loss or damage, costs expenses, or other claims for compensation whatsoever (whether caused by the negligence of Ford, its employees or agents or otherwise) which arises out of or in connection with the supply of the Goods and the entire liability of Ford shall not exceed the price of the Goods, except as expressly provided in these terms.

8. Ford shall not be liable to you for any delay in performing, or any failure to perform, any of Ford's obligations in relation to the Goods, if the delay or failure was due to any cause beyond Ford's reasonable control. Without limiting the foregoing, the following shall be regarded as causes beyond Ford's reasonable control:

  1. Act of God, explosion, flood, tempest, fire or accident.
  2. War or threat of war, sabotage, insurrection, civil disturbance or requisition.
  3. Acts, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority.
  4. Import or export regulations or embargoes.
  5. Strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of Ford or of a third party).
  6. Difficulties in obtaining raw materials, labour, fuel, parts or machinery.
  7. Power failure or breakdown in machinery.
  8. Dulling of frames due to the effects of weather conditions
  9. Discolouration of acrylic or polycarbonate translucent roofing materials due to biological or atmospheric conditions.
  10. The failure of the Goods to reduce or eliminate condensation.

9. Ford shall have no liability in respect of general maintenance requirements.
